Breaking Down Nevada Landlord Tenant Law
Landlords and tenants have mutual responsibilities under the contracted agreements of a lease.
If either party fails to meet their responsibilities, the other can take certain steps to enforce their rights.
In breaking down Nevada landlord tenant law, here are the key points to consider.
1. Tenants Can Withhold Rent To Pay For Repairs.
Tenant must provide a proper notification to their landlord about a habitability condition within the rental unit.
The issue must not have been caused by the tenant. If the issue is not repaired in a reasonable amount of time, tenants can pay for it themselves and seek relief through a lower rental payment.
They can also terminate the lease or seek relief through the court.
2. There Is a Security Deposit Limit.
Landlords are allowed to charge a security deposit that is equal to 3 months of rent on the rental unit in question.
3. The 3 Day/5 Day Eviction Process Can Be Confusing.
When there is a lease violation, a landlord may be able to issue a 3 Day Notice to bring the tenant back into compliance.
If this happens, then the notice is canceled. If the tenant does not comply, then a 5 Day Notice should be issued to begin the eviction process.
The 5 Day Notice can start the eviction process even if the tenant does eventually come back into compliance.
4. A 24 Hour Notice For Entry Is Mandatory.
The only exception to the landlord's need to provide their tenants with a 24 hour notice for entry to inspect or repair is an emergency situation.
Tenants may also give their permission for the landlord to enter.
5. Retaliation Is Assumed Under State Statutes For Specific Actions.
Any action taken by a landlord after a tenant joints a tenant union, complains to a building inspector or government agency, or complains to the landlord about unsafe living conditions is assumed to be retaliation.
Documented evidence of the violation must be present for the landlord to present their case.
Nevada's landlord tenant law has some unique stipulations as well, such as allowing tenants to display the US flag should they desire.
