These laws aim to strike balance between the tenant and the landlord, giving a landlord access that he/she needs to a rental property but without allowing much harassment and intrusion. Once the landlords and the tenants both understand the law regarding this matter, there is definitely no excused for any landlord who abuses these rules.
In Case of an Emergency
Your landlord has a right to get inside your apartment without asking permission in an event of emergency. An emergency can be defined as a situation where lack of actions will cause damages to the apartment. Examples of these are fire, gas leak, and open window in serious rainstorm, a broken water pipe. There are actually no restrictions as to what time your property-owner can enter during an emergency.
Making Needed Repairs
A landlord has a responsibility to keep the property in good and habitable condition. He/she should perform needed maintenance tasks. However, your landlord should provide you with appropriate written notice if he/she needs to enter your apartment in order to make some repairs. This notice should state when and why the landlord needs to enter your unit. Your landlord should schedule his/her entry during appropriate business hours, on weekdays, and must also leave written evidence like a business card or a note, indicating that he/she was inside your unit.
Allow Access for Professionals
Many maintenance and repair tasks are way beyond the capabilities and skills of the landlord. Thus, outside professionals should be hired in. Electricians, plumbers, contractors, and HVAC experts may need to access the property in order for them to perform the needed tasks that will keep your unit habitable.
Showing the Rental Unit to Prospective Tenants
A landlord has a right to make sure that their rental units are constantly occupied. When you give notice of vacating, or receive a termination notice, your landlord begins to look for a new tenant. Sometimes, a landlord wishes to offer the rental unit for sale and may need to let prospective buyers to see the unit. However, your landlord should notify you, the current tenant, when prospective buyers or tenants will be seeing the property. Additionally, the landlord should accompany the viewers and then leave the written evidence stating that he/she entered.
As a tenant or as a landlord, you should be well aware of such law in order to avoid unwanted misunderstandings and inconveniences between the tenant and the landlord. Remember, an entry without any permission can be considered a breach of obligations. And it this will happen repeatedly, and then you can take some legal actions. Tenants and landlords have different rights and different responsibilities as well. They should be very particular to these rights and responsibilities in order to encourage a harmonious and professional relationship between them.
