Easy Guide to Nebraska Landlord Tenant Law

1. Security Deposits and Pets
Landlords are not required to allow pets.
For those that do, a pet security deposit may be required. Nebraska requires a pet deposit to be capped at 25% of the regular monthly rent that is required in a rental agreement.
2. 7 Day Abandonment
Tenants are required to notify their landlords if they will be away from their rental unit for more than 7 days.
If this notification does not take place, then landlords in Nebraska may be allowed to remove tenant property and rent the unit to someone else.
3. The 3 Day Notice
If rent isn't paid on time in Nebraska, then a 3 Day Notice to Pay or Quit is issued by the landlord.
This gives a tenant 3 days to pay their entire past due rent and any late fees the lease requires.
If the entire amount is not paid, then the landlord can legally proceed with the eviction.
Only a court order, however, can force a tenant to move out of a rental unit under these circumstances.
4. Verbal Leases Can Be Terminated
If there isn't a written lease in place, then a landlord can terminate the agreement without needing a reason to do so.
A 30 day written notice terminating the oral agreement is all that Nebraska law requires.
5. The Right to Withhold and Deduct
Landlords are required to provide certain services to a rental unit, such as hot water and heat.
If this does not occur and tenants have notified their landlord of the situation, then they can withhold rent and pay for the repair on their own.
Tenants can also choose to move out until the repair has been completed and not owe rent for the days they are unable to live on the property.
