Explanation Of The Indiana Landlord Tenant Laws

Indiana Landlord Tenant Laws are stipulated under the Article 31 of Title 32 of Indiana State Code. The Article comprises of all the legal provisions that explain the role of a landlord, the role of a tenant, the obligations and rights of both the parties and how their relationship should be brought into effect, carried out and terminated at the desirable or at an untoward time. The Article takes into account Indiana building norms and all other laws that relate to infrastructure, ownership of properties and fair housing practices.

There are a total of nine chapters in Article 31 that deals with Indiana Landlord Tenant Laws. The chapters discuss distinctly different aspects of the landlord tenant relationship and sheds light on all legal aspects that should be adhered to at all times.

General Provisions

The general provisions deal with definitions of legal terms and all concepts that are used and explored while landlords launch rental properties, rent them out and when tenants use the rental properties. These provisions are the foundation based on which the residential rental industry functions.


The second chapter of Indiana Landlord Tenant Laws deal with all the factors pertaining to lease agreements, especially regarding leases that are longer than three years. Short term rental arrangements are much less complicated than long term leases and Indiana state makes an exception to have a different section dedicated to such agreements.

Landlord Tenant Statutes

All legal provisions that govern the initiation of a tenant landlord relation, through the application processes and agreements to the execution of the agreements and the tenant moving in are recorded in an exclusive chapter of Indiana Landlord Tenant Laws.

Security Deposits, Right of Access, Moving & Storage of Property

In the subsequent chapters of Article 31, landlords and tenants are explained the norms of security deposits, the clauses that must govern their refunds or their non-refunds, moving the property and storing them or moving them out and right of access for both parties.

Rights & Obligations Of Both Parties

It is quintessential that a landlord and a tenant understand their roles, rights and obligations, not only towards the property but for each other and for the neighborhood at large. From safekeeping of the property to ensuring the adherence to laws of the state and the building codes, all such provisions are listed in Indiana Landlord Tenant Laws.

The Article also discusses disputes, eviction and all legalities that may arise between two parties.
