Kentucky Renters Rights: Things You Need To Know

There are certain areas of Kentucky's landlord-tenant law that outline specific duties and responsibilities that each party must perform. If violated, there may be legal options available to either party. When it comes to Kentucky renter rights, here are the things you need to know.

1. Landlords Must Keep Renter Security Deposits Separate.

The security deposit that is given for a rental unit must be kept in a separate bank account from other funds. If this does not occur, then a landlord is not eligible to keep any portion of the security deposit.

2. There Are Returned Check Fee Limits.

Landlords may charge a maximum of $50 if they receive a returned check. This action may also result in Termination for Nonpayment notice that offers 7 days to remedy the situation or move out.

3. Tenants May Receive An Unconditional Quit Notice.

If the same lease violation occurs 2x within a 6 month period, then landlords may instead issue a 15 day unconditional quit notice. This requires a tenant to move out or face a legal eviction.

4. Tenants Are Allowed To Repair And Deduct.

If tenants provide their landlord with 14 days notice of a repair issue and it is not resolved, then they are allowed to deduct rent if the repair is the lesser of $100 or 50% of the monthly rent. If landlords are failing to provide essential services, such as hot water or heat, then tenants are allowed to withhold rent based on the pro-rated time of the month that this has occurred.

5. Several Areas Of The Landlord-Tenant Relationship Have No Laws In Kentucky.

There are no statutes on the late fees a landlord may charge, how much of a grace period past the first of the month a landlord may allow, and no statue for notice of a rent increase.

6. Protections Against Retaliation.

Landlords cannot terminate or refuse to renew a lease for a minimum of 1 year or fine tenants if they complain about certain rental violations. If this does happen, the legal assumption is that retaliation is occurring in the landlord-tenant relationship. The Kentucky laws that govern the rental relationship offer specific guidelines that must be followed.
