The Key Points of Arizona Renters Rights

Renters in Arizona have the right to have all communications from their landlord in writing. All conversations that take place with a renter be corroborated with documentation as well. Here are some of the other key points of Arizona renters rights to consider as well.

1. Security Deposits Can Be 1.5x Monthly Rent.

A landlord is allowed to charge a security deposit that is equal to 1.5x the monthly rent. Once the lease has been signed, however, renters have the right to have the advertised security deposit for their unit. Landlords are not allowed to increase a security deposit after a lease has been signed.

2. You Can Walk Through The Home.

Part of the move-in process is to walk through the home to document its condition. Renters have the right to take pictures during the inspection process. A damage checklist does not need to be provided by the landlord, but one is available to renters as Form A of Arizona's renters rights pamphlet. This document can be signed, dated, and given to the landlord. This and other signed documents must be given to tenants as copies.

3. 48 Hours Of Notice Is Generally Required.

Unless there is a need to enter a rental unit because of an emergency or there is a court order, landlords must provide 2 days' notice to enter a premises. If this has not been received, then tenants can refuse entry.

4. The Unit Must Be Habitable.

Landlords are required to maintain all sanitary, electrical, heating/cooling, ventilation, and all other systems to keep a rental unit habitable. All repairs necessary for this condition are also the responsibility of the landlord, though the cost may be assigned to the tenant if it is the tenant who caused the damage. Running water is also considered an essential service.

5. Landlords And Tenants Can Make a Maintenance Agreement.

Tenants may agree to maintain a home in regards to habitable repairs, but there must be compensation received for this agreement. If compensation is not given, then the landlord has failed to meet their obligations and the lease may be considered illegal.

6. A 5 Day Notice Is Required For Nonpayment Of Rent.

Landlords must give tenants 5 days to pay their rent when it is past due before proceeding with an eviction. 10 days notice is required for breaking most other lease rules.
