What Is the Eviction Process in Wyoming
For rental properties in the state of Wyoming, tenants may be evicted for failing to pay their rent or abiding by the promises made in a leasing agreement. When a failure to pay the rent is the issue, then a 3 day notice to vacate or pay must be given to a tenant before the eviction process is allowed to begin. This notice cannot be given to a tenant until the rent is 3 days late. If there is a violation of the leasing agreement outside of payment, however, the 3 day notice can begin immediately. Only after the 3 day notice has expired without resolution can a landlord begin the eviction process in Wyoming. Landlords must file a complaint with their local district circuit court to request a forceful entry through a detainer suit. Once the complaint has been filed, a summons will be issued and a date set for a hearing on the matter. Tenants can challenge the complaint at the hearing and a final decision will be issued at that time.
Any self-eviction methods a landlord may use can be used by a tenant as an eviction defense. Any violation of the eviction procedures set forth in Wyoming's landlord/tenant law can allow a tenant to request a delay in the proceedings. If there are grounds to evict a tenant, it means the landlord may need to start the eviction process over from the beginning. A common defense tactic by tenants is to claim that the rental unit is uninhabitable. In Wyoming, tenants must provide landlords with written notice about any repairs that are necessary. Tenants are not allowed to withhold rent under any circumstances. Landlords cannot request an eviction, however, just because rent remains unpaid. If the court finds in favor of the landlord, then a Writ of Restitution may be requested. This will force a tenant to vacate the property by a specific time or have a Sheriff's deputy come to remove any people who still occupy the unit. Tenants may be arrested for trespassing and law enforcement can seize personal possessions to pay for the cost of the eviction.
